Cancellation and Withdrawal Information

This page distinguishes Baymity's intermediary service from the direct Parking Agreement and explains how cancellations and any statutory withdrawal right work.

Version 2026-10-18 · Last updated 18 October 2026

1. Which contract are you cancelling?

A confirmed booking normally involves two distinct relationships: Baymity provides the Guest with a fee-bearing intermediary service, while the private Supplier and Guest enter into the Parking Agreement directly. Stripe provides payment services under its own terms.

Baymity currently permits only private, non-commercial Suppliers. The direct Parking Agreement is therefore normally a private-to-private contract, not a consumer contract with Baymity. Statutory consumer withdrawal rules generally do not apply to that direct private Parking Agreement. The cancellation rights displayed for the booking still apply.

Whether a Supplier acts as a trader depends on their actual activity, not merely on a private-Supplier declaration or listing label. If a Supplier is legally acting as a trader, any mandatory consumer rights in relation to that Supplier remain unaffected.

2. Contractual cancellation before parking starts

The application permits cancellation before the parking period starts and before capture: while payment setup is pending, after the payment method has been saved but no money is held, or while the payment is only authorised. Before capture, Baymity instructs Stripe to cancel the payment attempt or release the authorisation. The card issuer decides when any reserved amount becomes available again.

Signed-in Guests use the cancellation control for the booking in their dashboard. Account-free Guests use the confidential management link in their confirmation email. If the link is unavailable or the control cannot be used, contact Baymity at hello@baymity.com with the booking reference. Deleting an account, closing Stripe, or abandoning a confirmed booking does not cancel it. An unfinished checkout hold normally expires after 15 minutes.

Stripe normally authorises about 24 hours before arrival and captures about two hours before arrival; either step may happen immediately for a booking inside that window. Saving a payment method alone does not move money. The cancellation cutoff depends on whether capture has actually occurred and whether parking has started, not just whether you have entered payment details.

After capture or after the parking period starts, no automatic contractual cancellation right applies unless the Booking Details say otherwise. Mandatory rights, including for an unavailable, unsafe, inaccessible, or materially misdescribed space, remain unaffected.

3. Withdrawal information for Baymity's intermediary service

If you are a consumer, you have the right to withdraw from the distance contract for Baymity's fee-bearing intermediary service within 14 days without giving any reason. The period begins when that contract is concluded. To exercise the right, send an unequivocal statement to Baymity UG (haftungsbeschränkt), Luhnenstraße 7, 30559 Hannover, Germany, or by email to hello@baymity.com. It is sufficient to send the notice before the period expires.

If you expressly requested Baymity to begin the intermediary service before the withdrawal period ended and then withdraw before it is fully performed, you must pay a proportionate amount for the service supplied up to the withdrawal notice where the statutory conditions are met. A withdrawal right expires early only where all statutory requirements for early expiry have actually been satisfied, including complete performance, your prior express consent to early performance, and your acknowledgement that full performance ends the right. Accepting the Terms or saving a payment method alone does not end that right.

Following an effective withdrawal, Baymity will reimburse payments it received for its intermediary service without undue delay and no later than 14 days after receiving the withdrawal notice. Baymity will use the original payment method unless you expressly agree otherwise; you will not be charged a fee for the reimbursement. Any proportionate payment lawfully due for services already supplied is governed by the preceding paragraph. Withdrawal from Baymity's intermediary contract does not by itself cancel the separate Parking Agreement or create a right to reimbursement of the Supplier's parking price.

4. Model withdrawal form

You may, but do not have to, use the following text:

To: Baymity UG (haftungsbeschränkt), Luhnenstraße 7, 30559 Hannover, Germany, hello@baymity.com

I/We hereby withdraw from the contract concluded by me/us for Baymity's intermediary service relating to booking [booking reference, if available].

Ordered on: [date]

Name of consumer(s): [name]

Address of consumer(s): [address]

Date: [date]

Signature (only if submitted on paper): [signature]

5. Complaints and refunds

The in-app complaint window runs until 72 hours after the booked parking period ends. Account-free Guests can report a problem through their booking-management page and contact support by email; they do not have signed-in complaint messaging or ratings. This operational window does not shorten a statutory withdrawal, refund, damages, or payment-provider dispute right. Contact Baymity by email where the in-app window has ended but a legal claim remains.

Report an occupied, unavailable, unsafe, inaccessible, or materially different space as soon as possible through the application or to hello@baymity.com and provide only the evidence reasonably needed. Approved refunds after capture are returned through Stripe to the original payment method where practicable. Full details are in Section 10 of the Terms of Service.

6. Cancelling an optional location alert

Use the management link in an alert email to cancel that alert and withdraw your consent. You can also contact Baymity at the email above. This stops future alert processing; a message already being delivered may still arrive. Cancelling an alert does not cancel a parking booking, close an account, or stop necessary booking communications.
