Baymity legal

Terms of Service

These Terms govern accounts and use of Baymity, including listing, finding, reserving, and coordinating access to private parking spaces.

Version 2026-10-18 · Effective and last updated 18 October 2026

1. Operator, scope, and contact

Baymity is a service operated by Baymity UG (haftungsbeschränkt), Luhnenstraße 7, 30559 Hannover, Germany, represented by Managing Director Constantin Xylouris (“Baymity”, “we”, “us”). Registered in the Commercial Register of Amtsgericht Hannover under HRB 231473. Contact: hello@baymity.com.

These Terms apply to every registered user, every Guest who books without an account, and all use of the Baymity website and web application, including when added to your device's home screen. The Privacy Policy explains how personal data is processed. The Impressum contains the statutory provider information.

2. Definitions

  • Supplier means a user who lists a parking space that the user is entitled to make available.
  • Guest means a registered user or account-free visitor who requests or makes a booking.
  • Host means a user asked to assist with building or garage access. A Host is not Baymity’s employee or agent.
  • Parking Agreement means the direct agreement between Supplier and Guest for the temporary use of the booked space.
  • Booking Details means the listing, times, price, fees, cancellation information, access instructions, and other information displayed before confirmation.
  • Stripe means the Stripe entity that provides payment, identity-verification, connected-account, and payout services in the relevant country.
  • Connected Account means the Supplier's Stripe payment account linked to Baymity for direct Guest charges and Supplier payouts.

3. Eligibility, accounts, and acceptance

You must be at least 18 years old and legally capable of entering into contracts. You must provide accurate, current information, keep your contact and vehicle details updated, and protect access to your email and account. An account may not be transferred or used for another person without Baymity’s permission.

You accept these Terms by actively selecting the agreement checkbox and completing sign-in or account creation. Baymity records the accepted document versions and the server-side acceptance time. An account contract is concluded when Baymity enables the account after that acceptance. Baymity may reject or restrict an account for a legitimate reason, including security, sanctions, fraud, legal compliance, or a prior material breach.

The account service starts at your request immediately after registration. You may end the free account contract at any time by contacting Baymity. You can also request account and personal-data deletion from Profile details. Any statutory withdrawal right and any right to delete personal data remain unaffected.

A Guest may book without creating an account only where the Supplier has enabled that option for the selected space. The Guest must still provide an accurate name, email address, vehicle plate, payment permission, active acceptance of these Terms, and acknowledgement of the Privacy Policy. Accepting these Terms or acknowledging the Privacy Policy is not consent to optional analytics, alerts or marketing. Cookieless web analytics stays off until you give separate Analytics consent in Cookie Settings; declining or withdrawing that consent does not affect account access or booking. The booking-specific confirmation link acts as confidential access to that reservation and must not be shared. Account-free Guests do not receive account history, in-app complaint threads, or rating features.

4. Baymity’s role and the direct Parking Agreement

Baymity provides the technical marketplace, search and booking tools, payment coordination, access coordination, ratings, and complaint tools. Unless Booking Details expressly state otherwise, Baymity neither supplies nor rents the parking space and is not a party to the Parking Agreement. The Supplier is responsible for providing the booked space and access; the Guest is responsible for proper use and payment.

A Parking Agreement is formed when the booking is confirmed in the application, subject to any clearly displayed host approval or payment condition. Its content consists of the Booking Details, these marketplace rules where they concern Supplier and Guest, and applicable law. Baymity may transmit declarations and send booking-related instructions to Stripe for the parties without becoming the Supplier, payment-services provider, or guarantor of their obligations.

Searching, checking coverage, opening a listing link, or selecting a result does not reserve a space. Review and correct the destination, dates, vehicle details, selected space, access conditions, and total price before submitting the booking and payment instructions. A temporary checkout hold normally lasts 15 minutes and can expire if payment setup is not completed. The application confirms the reservation after successful payment-method setup, subject to any displayed access condition. A later search or alternative-time suggestion does not change an existing reservation.

Booking details are stored by Baymity and can be accessed through the signed-in booking dashboard or, for an account-free booking, the confidential confirmation link. Save the confirmation and the applicable Terms for your records; the public legal pages may later show a newer version. Guides and demonstration videos explain the service; the actual Booking Details determine the space, price, access conditions, and payment timing.

Baymity does not perform a comprehensive legal-title, identity, insurance, criminal-record, structural-safety, or vehicle check unless a specific check is expressly described in the interface. Badges, ratings, payout readiness, or moderation history are not guarantees.

5. Supplier obligations

A Supplier must:

  • have the owner’s or other sufficient authority to offer the space and comply with the lease, condominium association, house rules, access rules, insurance terms, permits, and applicable law;
  • provide a complete and accurate listing, including location, dimensions or restrictions where relevant, price, availability, access method, hazards, and any vehicle limitations;
  • keep availability current, prevent double bookings, provide agreed access on time, and honour confirmed bookings;
  • take reasonable care that the space and access route are usable and do not present an undisclosed danger;
  • maintain appropriate insurance and handle any tax, permit, invoice, or reporting duty arising from the Supplier’s activity;
  • complete Stripe's hosted onboarding, accept the applicable Stripe Connected Account Agreement, provide accurate verification and payout information directly to Stripe, and keep the Connected Account eligible for charges and payouts; and
  • cooperate promptly with cancellations, refunds, complaints, safety incidents, and legally required information requests.

Baymity currently permits listings by private, non-commercial Suppliers. A person acting for purposes relating to a trade, business, craft, or profession may not list without Baymity’s prior approval and completion of any trader verification and consumer-information process. A user must truthfully declare any trader status requested by Baymity.

When creating a listing, the Supplier gives a versioned declaration that the Supplier has sufficient authority to offer the space, that the listing complies with the property and access rules described above, and that the Supplier is acting privately and non-commercially. Baymity records the declaration version and server-side confirmation time. The declaration must remain true while the listing or its availability is published. A Supplier must stop publishing immediately and notify Baymity if the authority or status changes.

A Supplier may choose separately for each space whether to accept account-free Guests. This option is disabled by default. Enabling it means the Supplier accepts bookings made with the booking-specific contact and payment evidence shown by Baymity, without relying on a Baymity account or Guest rating.

Suppliers can prepare their space details and availability before completing Stripe onboarding. Preparation, visibility in the public directory, and an onboarding status do not by themselves make a space bookable. New bookings require an eligible Stripe Connected Account with charges and payouts enabled, as well as available dates and the other booking conditions. Tax-profile information requested by Baymity is separate from Stripe's payment-verification process.

Listing locations and selected listing details can appear in public discovery and shared booking links. Supplier promotion tools let you create QR-code flyers and copy suggested messages for your own listing. Check their accuracy before sharing, obtain permission to place printed material, and comply with advertising, messaging, and recipient-consent rules. Do not put private contact details, door codes, keys, or other confidential access credentials in public listing or promotional text. Printed prices and availability can become outdated; the current booking offer must be checked in Baymity. A flyer or shared link does not guarantee a booking or income.

6. Guest obligations

A Guest must:

  • use the space only during the booked period and only for the vehicle identified in the booking;
  • ensure the vehicle is roadworthy, properly registered and insured, and operated by a licensed driver;
  • follow access instructions, height and weight limits, fire-safety rules, signs, house rules, and reasonable directions of the Supplier or Host;
  • avoid obstruction, nuisance, damage, unlawful activity, vehicle repairs, storage of hazardous materials, or charging an electric vehicle unless expressly allowed;
  • remove the vehicle on time, return access devices, and pay reasonable, evidenced costs caused by a culpable overstay, damage, lost device, or other breach; and
  • inspect obvious access and safety conditions and immediately report an unavailable, occupied, unsafe, or materially misdescribed space.

Making a parking space available does not by itself create an agreement to safeguard the vehicle or its contents. Baymity does not take custody of the vehicle. This does not exclude the Supplier's or Baymity's liability for damage for which they are legally responsible.

Optional vehicle-size filters compare the dimensions you enter with limits published by the Supplier. An omitted height, width, or length limit means that limit is unknown, not that every vehicle fits. Check the vehicle, entrance, access route, and listed restrictions before booking. A search match is not a vehicle inspection or a guarantee of clearance.

7. Hosts and access coordination

A Supplier or Guest may request assistance from a Host. A booking may remain conditional until the Host accepts. Hosts must provide only accurate availability and access information, safeguard entry credentials, and avoid sharing unnecessary personal data. Baymity does not guarantee that a Host will accept, arrive, or successfully provide access.

The separate Share with host or Share visit tool opens your device's sharing options, copies visit text, or prepares an email in your email application. You choose the recipient and send it yourself. Sharing a visit does not create a Host account, record formal Host approval, or replace any access condition shown for the booking. Do not share the confidential booking-management link.

8. Search order, ratings, and booking decisions

Search compares Baymity listings, not every parking provider in the area. Eligibility depends on the requested time, active availability, existing reservations, vehicle limits where supplied, account-free booking settings, applicable rating thresholds, and Supplier payment readiness. The search first considers the destination address or, if no exact listing exists, a supported address for access-controlled parking. Eligible results in those groups are ordered by total Guest price, lowest first.

If there is no eligible result for the requested time, the search can offer independently accessible spaces within 500 metres. Nearby results are ordered by approximate distance first and total Guest price second. An explicit wider-area option may show up to five results beyond 500 metres and within 2 km in the same order. Later-time suggestions give priority to the earliest suitable start; ties between nearby spaces use distance before price, and other ties use price. Distances are straight-line estimates, not walking routes. Search can refresh automatically as valid destination, time, or vehicle inputs change.

The Explore directory shows active listings in a stable listing order, not by price, distance, or a recommendation score. Directory presence and a coverage result do not confirm availability, payment readiness, or vehicle suitability. A shared listing link helps locate that particular space but does not bypass eligibility checks. Baymity does not currently sell placement in search results.

Suppliers may set a minimum Guest rating. The system can prevent a booking below that threshold. Users may ask Baymity to review a disputed rating or eligibility decision. Ratings are user opinions based on platform activity, may contain error or bias, and are not Baymity endorsements. Baymity may remove ratings that are fabricated, retaliatory, irrelevant, unlawful, or manipulated.

Minimum-rating rules and post-booking ratings apply only where the Guest used a registered Baymity account. Neither the Supplier nor an account-free Guest can rate the other party for an account-free booking. Existing Supplier ratings may still be displayed as general trust information before booking.

8a. Optional new-listing alerts

You can request an email alert for a selected area without opening an account. The alert requires your separate consent and confirmation through the emailed management link. An unconfirmed request expires after 24 hours; a confirmed subscription lasts up to 90 days and ends after one new-listing notification or earlier cancellation.

The alert checks for an active listing created after your request at the precise destination address you entered, including listings requiring access coordination or an account, or a freely accessible, account-free listing within 500 metres of that address. It does not monitor cancellations, your preferred dates, vehicle fit, or a guaranteed price. Checks run periodically, so delivery is not immediate. The notification is not a reservation or a promise that the space can be booked. Use the email's management link to cancel; this does not cancel a parking booking or affect its service emails.

9. Prices, Stripe direct charges, and Supplier payouts

For new bookings covered by the processing-fee reimbursement policy, the default Supplier commission is 15% of the parking subtotal and the Guest pays a separate EUR 1 booking fee. With these defaults, the Supplier retains 85% of the parking subtotal after ordinary Stripe payment-processing fees have been reimbursed, rounded down to the nearest cent and before the Supplier's taxes, refunds or reversals. Any different country-specific commission or booking fee must be shown before booking; the agreed booking snapshot controls. Existing bookings retain their recorded prices and reimbursement policy.

Stripe initially deducts its processing fee from the Supplier's Connected Account. Baymity then credits the actual ordinary booking-processing cost from Baymity's own Stripe balance in the same currency, using the recorded Stripe balance transaction. This separate credit may arrive after the parking proceeds; a pending or failed credit remains owed and is shown separately until completed. It is not a bank-payout guarantee or a change to who provides the parking service. A Guest refund does not itself reverse this processing-cost credit. Optional Instant Payouts, currency conversion, dispute or chargeback fees, and Supplier taxes are not reimbursed under this policy. Where Stripe cannot separate a converted or unrecognised fee automatically, Baymity reviews the covered processing cost instead of treating it as reimbursed.

The Guest total, currency, parking subtotal, Baymity booking fee, and other price components are displayed before the payment commitment. The displayed total controls for that booking. Baymity may change fees for future bookings, but not retroactively for an already confirmed booking.

New booking payments are processed only by Stripe, using the payment methods offered at checkout. Historical PayPal transactions may still need reconciliation, refunds, or support, but PayPal is not offered for new bookings. The Guest charge is created directly on the Supplier's Connected Account, and Stripe allocates the disclosed Baymity application fee to Baymity. The Supplier is the provider and payment recipient for the parking service. Baymity does not receive or hold the Supplier's share in a Baymity-owned bank account or Stripe balance and does not provide an escrow, deposit, or payment-account service. Stripe, as the payment-services provider, holds and moves the funds under its terms.

To secure a booking, the Guest must actively permit Stripe to save a payment credential for that identified booking and permit the Supplier, acting through Baymity and Stripe, to initiate one payment of up to the displayed Guest total while the Guest may be offline. Saving the credential alone is not a charge, although authorization or capture may follow immediately where the booking is already inside the timing windows below. Baymity will not use it for an unrelated or recurring charge, or for a later booking without a new instruction. Stripe, not Baymity, receives the complete card or bank details.

Unless Booking Details show different times, Stripe normally seeks authorization about 24 hours before arrival and Baymity instructs capture about two hours before arrival. If payment setup occurs inside either window, the relevant step may occur immediately. An authorization is not a completed charge, but the Guest's bank may reduce available funds until it is captured or released. Authentication, issuer approval, provider holds, exchange rates, and processing times remain subject to Stripe and the Guest's payment provider. If authentication or a replacement method is required and is not completed in time, the reservation may be cancelled.

The Supplier authorizes Baymity to send instructions to Stripe within the scope of a Baymity booking: to create, confirm, authorize, capture, cancel, or refund a direct charge; collect the disclosed Baymity fee; and obtain payment and dispute status. Stripe controls the Connected Account's availability and automatic payout schedule. This limited authority does not make Baymity the parking supplier, custodian of Supplier funds, or guarantor of payment.

After capture, the Supplier's amount remains in the Connected Account until Stripe makes it available and pays it to the Supplier's verified bank account under the Supplier's Stripe payout settings. Baymity does not release or manually pay out these funds. Stripe and the Supplier's bank control final availability and settlement time.

A Guest may submit a Baymity complaint for 72 hours after the booked parking period ends. During that operational review window, the Supplier authorizes Baymity to instruct Stripe to refund all or part of the direct charge where Baymity reasonably concludes that the parking service was unavailable, materially defective, fraudulent, or otherwise refundable under the Parking Agreement or applicable law. A refund instruction also reverses the corresponding Baymity application fee where supported by Stripe. The end of this voluntary complaint window does not limit statutory rights, card-scheme chargeback rights, or other rights that cannot legally be excluded.

The Supplier authorizes Stripe and Baymity to apply a valid cancellation, refund, chargeback, or payment reversal to amounts linked to the affected Parking Agreement and, where legally and technically permitted, to deduct or set off that amount against funds otherwise payable for the booking. The Supplier is responsible only to the extent the adjustment results from the Parking Agreement, the Supplier's breach, or a risk lawfully allocated to the Supplier. Baymity remains responsible for its own fee, fault, and non-transferable legal duties. Baymity will provide available transaction information and a reasonable review route for a disputed adjustment.

Users must not circumvent Baymity’s payment flow for a booking initiated through Baymity, manipulate a price, reverse a legitimate payment, or use a payment method without authority.

10. Cancellation, unavailable spaces, refunds, and withdrawal rights

The application allows the Guest to cancel before the parking period starts and before payment capture, including while payment setup is pending, a payment method has been saved without a charge, or the payment is only authorized. Use the booking controls in the dashboard or the account-free confirmation link; contact Baymity if you cannot access them. Before capture, Baymity instructs Stripe to cancel the payment attempt or release the authorization; because no charge was completed, there is no refund amount. The Guest's issuer controls when reserved funds become available again. Once payment has been captured or the parking period has started, there is no automatic contractual cancellation right unless the Booking Details state otherwise. This does not limit a mandatory withdrawal, refund, price reduction, damages, or other statutory right.

If the Supplier cancels, fails to provide the confirmed space or agreed access, or the space is occupied, unsafe, or materially different from the listing, the Guest must report the issue promptly and provide reasonable evidence. Baymity may assist with an alternative, cancellation, or payment reversal. Baymity does not guarantee that an alternative space is available.

Where a consumer has a statutory withdrawal right for Baymity’s fee-bearing intermediary service or a Parking Agreement with a commercial Supplier, Baymity and the commercial Supplier will provide the legally required information and obtain any booking-specific request for performance before the withdrawal period ends. Statutory rights cannot be waived merely by accepting these Terms.

The separate Cancellation and Withdrawal Information explains the contractual cancellation process, the distinction between Baymity's intermediary service and a private Supplier's Parking Agreement, and how to exercise a statutory withdrawal right where one applies.

After capture, an approved full or partial refund is processed by Stripe against the direct charge on the Supplier's Connected Account and returned through the original payment method where practicable. Baymity also reverses its application fee in the corresponding full or proportional amount. Stripe and the Guest's provider control the time needed for the credit to appear. A chargeback should not be used to avoid the platform complaint process where that process can reasonably resolve the issue, but statutory and provider rights remain unaffected.

11. Taxes, identity checks, and reporting

Each user is responsible for their own income tax, VAT, trade, invoicing, registration, and other public-law obligations. Baymity does not provide tax advice. Baymity may request and verify identity, address, tax identification, payment-account, property, trader-status, and transaction information; restrict listings or payouts until supplied; and report information to authorities where required, including under platform tax-transparency rules such as DAC7 and the German PStTG. A report or a Stripe verification does not itself determine whether a Supplier owes tax or is legally acting as a trader.

12. User content, prohibited conduct, and licence

You retain the rights in the material you submit. You grant Baymity a non-exclusive, worldwide, royalty-free licence to store, reproduce, format, display, transmit, and moderate that material only as necessary to provide and secure the service and enforce its rules. Public listing material may also be used to promote that listing on Baymity. Private messages, contact details, and complaint evidence are not covered by this promotional permission. After the account or listing ends, further use is limited to existing bookings, legal duties, and necessary evidence for legal claims.

You must have all necessary rights and must not upload unlawful, misleading, discriminatory, threatening, defamatory, privacy-invasive, infringing, malware-containing, or fraudulent material. Do not photograph people, homes, access credentials, or unrelated vehicles unless necessary and lawful. Scraping, automated access without permission, interference with security, fake accounts, rating manipulation, and use of the platform to facilitate an offence are prohibited.

13. Moderation, illegal-content notices, and complaints

Baymity may investigate and proportionately remove or restrict content, listings, payments, features, or accounts where reasonably necessary for these Terms, safety, fraud prevention, third-party rights, or law. Depending on the case, measures may use rule-based signals such as booking status, ratings, duplicate listings, payment events, or reports; material moderation and disputed decisions receive human review.

Except where prohibited by law or necessary to prevent harm or abuse, Baymity will give the affected user a clear reason and available review route. Before a longer suspension for repeated manifestly illegal content or manifestly unfounded notices, Baymity will normally warn the user and assess frequency, proportion, gravity, consequences, and apparent intent.

To report specific allegedly illegal content, email hello@baymity.com with the exact URL or listing/booking identifier, a reasoned explanation of illegality, your name and email unless an applicable law permits omission, and a good-faith statement that the information is accurate and complete. Baymity will acknowledge sufficiently complete notices and communicate a decision and available redress without undue delay.

A user may request internal review by replying to the decision or contacting the same address. Any out-of-court settlement or judicial remedy available under applicable law, including the Digital Services Act where applicable, remains available.

14. Service availability and disclaimers

Baymity will provide its own intermediary service with the care required by law. Subject to that duty and the liability rules below, Baymity does not promise that the platform will be uninterrupted, error-free, permanently available, or compatible with every device; that a user will complete a booking or payment; or that user-provided information, ratings, access instructions, availability, authority, insurance, or conduct are accurate or reliable.

Maintenance, security incidents, provider outages, telecommunications failures, payment reviews, public-authority action, building restrictions, or events outside Baymity’s reasonable control may delay or prevent service. Baymity will take reasonable measures within its control to restore affected platform functions.

15. Liability

Baymity is liable without limitation for damage caused intentionally or by gross negligence; for injury to life, body, or health caused intentionally or negligently; under an expressly assumed guarantee; under the German Product Liability Act; and in every other case in which liability cannot lawfully be excluded or limited.

Subject to the unlimited liability described above, for slight negligence Baymity is liable only for breach of an essential contractual obligation whose performance makes proper performance of the contract possible and on which the user may regularly rely. In that case liability is limited to the damage that was foreseeable and typical when the contract was concluded. Liability for slight negligence is otherwise excluded.

The limitations apply equally to Baymity’s legal representatives, employees, and agents. They do not alter statutory burdens of proof. Baymity is not responsible as its own performance for a Supplier’s space, a Guest’s vehicle or conduct, or a Host’s assistance; Baymity remains responsible for its own selection, information, payment-coordination, security, and other duties to the extent imposed by contract or law.

16. User responsibility for claims

If a user culpably breaches these Terms or third-party rights and a third party asserts a claim against Baymity because of that breach, the user must compensate Baymity only to the extent the user is legally responsible. Baymity will give reasonable notice and allow the user to participate in the defence. This clause does not impose strict liability, shift a statutory burden of proof, or reduce consumer protections.

17. Suspension, termination, and data after termination

Users may terminate their account contract at any time. Existing Parking Agreements, payments, Connected Account adjustments, complaints, and obligations survive as necessary to complete or unwind them. Disconnecting or closing a Connected Account does not cancel an existing payment, refund, chargeback, reporting duty, or valid recovery claim. Baymity may suspend or terminate for a material breach, repeated misuse, safety or fraud risk, non-payment, legal requirement, or provider restriction. Where reasonable, Baymity will warn the user and allow a cure before termination; immediate action is permitted for serious risk, illegality, or an incurable breach.

Account termination does not require immediate deletion of data that Baymity must retain for payments, tax, accounting, fraud prevention, disputes, legal claims, or compliance. The Privacy Policy governs deletion and retention. Earlier encrypted recovery snapshots may remain for the limited backup periods described there after eligible data has been erased from active systems. Backup retention does not waive your statutory rights or authorise ordinary reuse of deleted data. Completed erasure requests and processing restrictions must be reapplied before restored data returns to ordinary use.

18. Changes to these Terms

Baymity may publish revised Terms for future contracts, for example to reflect changes in law, functionality, security, or service providers. Changes to an existing account contract require your express agreement unless they are permitted on another valid legal basis. Baymity will explain proposed material changes and when they are to take effect before asking you to accept them. Silence or continued use alone does not constitute acceptance. Confirmed bookings remain governed by the Terms agreed when they were concluded, subject to mandatory law. You may terminate the account contract if you do not accept a proposed change; rights and duties relating to existing bookings remain unaffected.

19. Governing law and venue

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice does not deprive you of mandatory protection under the law of the country where you habitually reside. Statutory courts have jurisdiction for consumers. Hannover is the exclusive venue only where the user is a merchant, a legal entity under public law, a public-law special fund, or another valid venue agreement is permitted.

20. Consumer dispute resolution and final provisions

Baymity is neither willing nor obliged to participate in dispute-resolution proceedings before a consumer arbitration board unless a specific legal obligation applies.

If an individual provision is invalid, the remaining provisions remain effective to the extent permitted by law. The statutory rule replaces an invalid provision; no clause is intended to reverse a statutory burden of proof or waive a non-waivable right. Failure to enforce a provision once is not a waiver.

Contracts with Baymity may be concluded in German or English. The contract language is German in the German-language registration or booking process and English in the English-language process. If another interface language is selected, the legal documents are provided in English and the contract language is English. The corresponding language version of these Terms applies. Mandatory language requirements, consumer rights, and statutory rules for interpreting standard terms remain unaffected.
